Australian visa condition 8509: apply for a substantive visa or show a ticket (2026)

Plain-language guide · general information, not immigration advice

Condition 8509 gives you a choice, and a short clock. Within 5 working days after the date your visa was granted, you must either make a valid application for a substantive visa, or show an officer a ticket to a country other than Australia that the Minister is satisfied will let you enter when you arrive. That is the text of condition 8509 in Schedule 8 to the Migration Regulations 1994 (Cth), as published on the Federal Register of Legislation as of the September 2026 version of that instrument.

What does condition 8509 actually say?

The operative words are short:

Within 5 working days after the date of grant, the holder must: (a) make a valid application for a substantive visa; or (b) show an officer a ticket for travel to a country other than Australia that the Minister is satisfied will allow the holder to enter on his or her arrival.

Three details do most of the work. The period runs from the date of grant, not from the date you receive a letter or read an email. It is expressed in working days, so the practical window is usually shorter than a calendar week. And it is framed as either/or: satisfying one limb satisfies the condition, and you do not have to do both.

What counts as a "valid application"?

A separate note in Schedule 8 points to section 46 of the Migration Act 1958 (Cth) for the meaning of a valid application, and describes it broadly as one that is formally in order for consideration — not necessarily one that can be granted.

That distinction matters for anyone racing the 5-working-day window. The condition asks whether a valid application has been made, not whether it will ultimately succeed. A properly lodged, formally complete application engages limb (a); how the case is later decided is a separate question. Conversely, an incomplete or wrongly lodged application may not meet the standard in section 46 even if you intended to comply.

What kind of ticket satisfies condition 8509(b)?

The text sets three requirements for the ticket route:

The third point is the one people underestimate. A booking to a country where you have no right of entry does not automatically discharge the condition, because the test includes whether you will be permitted to enter when you get there.

How is condition 8509 different from condition 8508?

The two conditions sit next to each other in Schedule 8 and are easy to confuse.

Condition 8508 Condition 8509
What you must do Make a valid application for a visa Make a valid application or show a qualifying ticket
Which visa A visa of a class that can be granted in Australia A substantive visa
Time limit Within the time specified by the Minister for the purpose Within 5 working days after the date of grant

The practical difference is that 8508 leaves the deadline to be specified, while 8509 fixes it at 5 working days in the text itself. 8509 also gives you an exit route — the ticket — that 8508 does not.

Which visas carry condition 8509?

Condition 8509 does not attach to every Australian visa. A note to the condition states that whether a visa of a particular class may be made subject to this condition depends on the relevant provision in Schedule 2 of the Migration Regulations 1994.

In practice this means the condition is imposed by the Schedule 2 criteria for the specific visa class, and the authoritative record of whether it applies to you is the condition list attached to your own grant. If 8509 is printed with your visa, the 5-working-day obligation applies to you; if it is not, it does not.

What happens if the 5 working days pass without either step?

Breaching a visa condition is not a minor administrative slip. The note to condition 8509 refers to the Migration Act 1958 sections 41 and 116 to 119 for cancellation for breaches of conditions. Sections 116 to 119 are the cancellation provisions to which the note points; the note does not set out the content of section 41.

What this article can say is limited to what the instruments say: the regulation sets the obligation, and the Act provides the cancellation consequences. How those provisions are applied to a particular case depends on facts the regulation text does not resolve, and this is general information about the law rather than advice on your situation — for anything turning on your own visa history, rely on the official current text and on a registered migration professional.

Frequently Asked Questions

Is 5 working days the same as one calendar week?

No. The condition counts working days after the date of grant, so weekends and non-working days are not part of the count in the way they would be for calendar days. The safe reading is that the deadline can arrive sooner than a week after your grant date.

Does applying for any visa satisfy limb (a)?

The text requires a valid application for a substantive visa, not simply any application. The word used is narrower than the wording in condition 8508, which refers to a visa of a class that can be granted in Australia. Whether the visa you intend to apply for is substantive is determined by the Regulations, not by the label on the form.

Can I get an extension of the 5 working days?

The text of 8509 sets the period at 5 working days after the date of grant and does not itself contain a mechanism for extending it. This contrasts with condition 8508, which is framed by reference to a time specified by the Minister. Treat the deadline as fixed rather than negotiable.

I made a valid application within 5 days but it was later refused — did I breach the condition?

Making the application is what limb (a) requires. The Schedule 8 note describes a valid application as one formally in order for consideration, and expressly not one that can necessarily be granted. A later refusal is therefore a different issue from compliance with 8509.

If I show a ticket, do I have to leave Australia immediately?

The condition requires you to show an officer a qualifying ticket within the 5-working-day window. It does not, in its own text, set a departure date, but a ticket that does not correspond to travel the Minister is satisfied will result in entry to that country does not meet limb (b).

Does everyone holding a visa subject to 8509 get the same choice?

Both limbs are available on the face of the condition: apply for a substantive visa, or show a qualifying ticket. Which one is realistic depends on your circumstances — for example, whether a substantive visa application is available to you and whether you hold a ticket to a country that will admit you.
